Terms of Service

These Terms of Service ("Terms") govern your use of the NepTrack mobile application and related services ("Service") operated by NepTrack ("we", "our", or "us"). NepTrack is Nepal's smart GPS tracker for vehicles and public services. By downloading, installing, or using NepTrack, you agree to be bound by these Terms.

NepTrack is an independent, third-party application and is not affiliated with, endorsed by, or representing the Government of Nepal or any government ministry, department, municipality, or authority.

All public service data (bus routes, emergency contacts, garbage schedules, highway and weather information) is sourced from publicly available official sources and is provided for reference only. NepTrack does not represent, speak for, or act on behalf of any government body.

• You must be at least 13 years of age to use NepTrack
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorised use of your account

NepTrack grants you a limited, non-exclusive, non-transferable, revocable licence to use the app for your personal, non-commercial purposes, subject to these Terms.

You may use NepTrack to:

• Monitor and track vehicles registered to your account
• Access public service information (bus routes, ambulances, EV stations, etc.)
• Receive alerts and notifications for your registered vehicles
• View trip history, mileage, and usage reports for your own vehicles
• Submit highway obstruction reports to assist other road users
• Trigger SOS alerts for genuine personal emergencies
• Scan vehicle QR codes using your device camera
• Sign in using your Google account, subject to Google's Terms of Service

You must not:

• Track, monitor, or surveil any person or vehicle without their explicit consent
• Submit false, misleading, or fabricated highway obstruction reports
• Trigger SOS alerts for non-emergency or prank purposes
• Use the service for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to any part of the service or its servers
• Reverse-engineer, decompile, or attempt to extract the source code of the app
• Use automated scripts, bots, or crawlers to access or scrape data from the service
• Upload or transmit malware, viruses, or any other malicious code
• Impersonate any person, entity, or government body
• Interfere with or disrupt the integrity or performance of the service
• Resell, sublicense, or commercially exploit the service or its data

You are solely responsible for:

• Ensuring that GPS tracking devices registered to your account are installed in vehicles that you own or have explicit authorisation to track
• Informing all occupants and drivers of a tracked vehicle that the vehicle is equipped with a GPS tracking device
• Complying with all applicable privacy and surveillance laws in your jurisdiction
• The physical security, maintenance, and proper use of any GPS hardware

NepTrack provides reference information about public services including but not limited to bus routes, ambulance services, EV charging stations, garbage collection schedules, highway alerts, and weather conditions.

NepTrack is not affiliated with, endorsed by, or responsible for any third-party public service providers listed in the app.

Highway Obstruction Reports

When you submit a highway obstruction report, you represent that the information is accurate and based on your direct observation. You are solely responsible for the content of your reports.

By submitting a report, you grant NepTrack a non-exclusive licence to share that report with alert station operators and other users to improve road safety.

SOS / Emergency Alerts

The SOS feature is designed to assist users in genuine emergency situations. It is not a replacement for Nepal's official emergency services.

When an SOS alert is triggered, the user's precise GPS coordinates, address, and alert type are transmitted in real time to the user's registered emergency contacts and to nearby registered stations on the NepTrack platform (which may include police stations, hospitals, and fire services registered on the system). NepTrack does not guarantee that any registered station will receive or respond to an alert.

NepTrack accepts no liability for failure to receive, process, or respond to SOS alerts due to network conditions, device issues, or other technical factors.

NepTrack may send you push notifications for vehicle events (geofence, speed, ignition, etc.), weather alerts, and service updates. You can manage notification preferences within the app or your device settings at any time.

Alert thresholds and geofence boundaries are configured by you. NepTrack is not liable for any loss or damage resulting from missed, delayed, or inaccurate alerts.

All content, features, design, trademarks, logos, and software within NepTrack are the exclusive property of NepTrack and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the service or its content, nor may you reverse-engineer or attempt to extract any source code from the app.

User-generated content (such as vehicle names, notes, or profile information you enter) remains your property. By submitting it, you grant NepTrack a non-exclusive licence to use it solely to provide the service to you.

The NepTrack service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

• We do not warrant that the service will be uninterrupted, error-free, or free of viruses
• GPS accuracy depends on device hardware, satellite signal, and environmental conditions
• Public service data is sourced from third parties and may not always be current or accurate
• We are not responsible for decisions made based on information provided by the app

To the fullest extent permitted by applicable law, NepTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from:

• Your use of or inability to use the service
• Unauthorised access to or alteration of your transmissions or data
• Theft, damage, or loss of a vehicle being tracked
• Inaccurate location, alert, or public service data
• Any other matter relating to the service

In no event shall NepTrack's total liability to you exceed the amount you paid (if any) for the service in the twelve months preceding the claim.

You may delete your account at any time from the app settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the use of NepTrack shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Kathmandu, Nepal.

We may update these Terms from time to time. When we do, we will update the "Effective Date" below and, where the changes are material, notify you via push notification or in-app message.

Your continued use of NepTrack after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the service.
